1)    The IEEE (The Institute of Electrical and Electronics Engineers) found that the guideline used for cell phone RF emission is extremely inadequate for children.  Current SAR (specific absorption rate) is based on a 200 pound man’s head which is not only significantly larger than a child’s but is also fully formed with a thicker skull.

2)    Upon reading the response I got from BC Hydro regarding my Fire Report, one member decided to check out one of the statements, the one about analogs not being available and found yet another “untruth”.  Hydro seems intent on sharing “alternative facts”.

The member offered, “It doesn’t actually claim that the meters are made in the US, but it does claim the US as country of origin, and on the “about us” page they say that all their products are new and factory sealed; none are refurbished. I also found numerous sources of (probably more poorly made) electromechanical analog meters made in China, and several sites that offer reconditioned analog meters. Including bi-directional meters for use with solar panels.”

Of course, if places like Calif. allow people to keep their analogs permanently, there has to be a source for them. Re. being made in the USA, I have been told by some insiders that smeters are made in China. Only the faceplates are made and installed in the US, hence the “made in the USA” that people see.

Thank goodness there is finally going to be a review of BC Hydro. An independent review is what’s needed. Please.

I would also like to respectfully request that included in this review will be a review of the Smart Meter Program. From Day One it has been fraught with questionable regulations and policies.For instance:

Why was the BCUC bypassed on approving or disapproving the smart meter program? Oh, I know, the Clean Energy Act, introduced by Gordon Campbell gave the right to bypass them. I wonder why? Perhaps he knew more than he would like them to know.

From Day One BC Hydro has lied to their customers. We were told that with smart meters on our homes, we would never have to worry about calling BC Hydro when there was a power outage because the smart meter would notify BC Hydro electronically when the power was out. Really? That hasn’t been my experience. In every instance I have had to call Hydro to let them know the power was off.

And that the smart meter would last 20 years. Really? Aren’t they about to be replaced after only 5-7 years? And at what cost to the ratepayer?

And what about all the fires that are occurring with smart meters? That information is being kept from the public. Why?  Most home owners have a right to know that they have a fire hazard on their wall. What about the legality of keeping this important information from us? 

And why the huge Legacy fee that some hydro customers are paying? Even FortisBC charges only $9.00/month for the same service. That’s extortion and it should be investigated.

All wireless technology and the Smart Grid can be easily hacked. Customers of BC Hydro are vulnerable as is everyone else in the world with a smart meter on their home. Imagine this scenario: A skilled hacker gets into the Smart Grid in the middle of a cold, cold winter. The Smart Grid goes down all over North America. People have no electricity…for days.

What were the bureaucrats thinking when they allowed Smart Meters to be put on homes? It was an insane decision. Our analogs would still be running happily and our privacy would be still be intact if we had kept Smart Meters off our homes. 

The Smart Meter Program will end up costing BC ratepayers millions if not billions when all is said and done.

It’s time that the lies and corruption of BC Hydro are brought out into the open…not just the financial mess they find themselves in.

According to Canadian sources Canada has 990 million acres of forests,

370 million acres of wetlands and 

167 million acres of crop-yielding farmland.

These are known as “carbon sinks”.  I.e. :-  they absorb carbon.

Biologists tell us that trees absorb about 2.6 tones of carbon per acre .

So if you do the math 990 million acres x 2.6 tones/acre=2.574 billion tones of carbon being absorbed every year here in Canada.

Now if you do more math: 36 trillion tones (amount of world emission x 0.0167 (1.67%)=601.2 million tones – this is the amount of carbon that Canada contributes to world emissions – in the forests alone, Canada absorbs almost 4 times the amount of carbon it emits.

AGAIN :–  In the forests alone, Canada absorbs  4 times the carbon it emits.

This means that the other three quarters of our forests are being sustained by carbon being emitted by the rest of the world.

This calculation does not take into account the wetland or farmland  that also absorbs  carbon.

Canada really couldn’t get any greener, so why are our politicians hell bent on punishing us with these ridiculous carbon taxes?

If the media were honest, this information would be made public. SHOULD BE MADE PUBLIC !

Considering the fact that Canada is given no credit for absorbing much more carbon than it emits I think there is a good case for some lawyer to charge governments with a  “class action suit “

1)    A member suggested I re-circulate an article that has been on our website for some time, re wired meters and safe technology used by Idaho Power. Years ago, in 2010, I asked BC Hydro is they had considered wired smeters, and they, as usual, didn’t tell the truth. They said that there were no such things. I told them about Idaho having them. Then they said (and Ted Olynyk repeated this lie in several public meetings) that they are for commercial use only and cost $35,000 each. When told again that Idaho uses them for homes, Hydro finally admitted that they didn’t ask. They were told about wireless being cheaper and went with it. Imagine if they had bought into a more expensive project !!! 

Idaho uses fiber optic cable for the most part, all wired connections that do not emit radiation, are more secure from hacking, and cost $152 per “end point”, where BC Hydro’s system costs $550.

Vermont also uses wired smeters and their costs were $266 per meter.

2)    A couple of weeks ago I received comments on my fire report from BC Hydro and Len Garis, They are below along with my response. Their comments are the only ones I’ve received to date. Nothing at all from Premier Horgan, Energy Min. Mungall or Transportation Min. Trevena, or any of the MLAs to whom I sent the report. It truly seems that no one wants to acknowledge that there is a problem. I realize that everyone is busy but I don’t think that is the reason no one is responding. I think they fear they will have to do something that they do not want to do. They must be in support of this expensive, dangerous, and unnecessary program now that they have the power to do something —  even if the smeters might burn a few homes down and put lives at risk.  I hope you will ask them. You might ask why the ITRON meters can’t be recalled and replaced with the wired meters like Idaho has, if they won’t support getting safe, dependable, long-lived analogs which would mean putting meter readers back to work.

Dear Mr. Wruck 

The comments provided by Mr. James and Mr. Garis are consistent with those made in response to my charges over the last 4 years. They evade and mislead. None of the critical issues that I raised in this comprehensive fire report are addressed 

1)    The expert information given by independent professional engineers regarding design flaws is ignored.

2)    One source and one source only is used by Mr. Garis, and that source is incomplete and erroneous in many regards.

3)    Mr. Garis failed to corroborate the information in the only source he used, failing to review the raw data which was readily available to him.

4)    Regulations and laws are being violated:

i)                   Meters are being removed from homes prior to the inspection. BC Hydro states otherwise and ignores the evidence provided by BCSA, the media and by witnesses.

ii)                Fire reports are not being completed in all situations where property is damaged.

iii)              Many electrical fires are not being inspected by the BC Safety Authority or the inspectors at the 9 jurisdictions.

iv)              Insurance reports are not available to victims or the general public.

5)    Loopholes in regulations exist which allow dangerous devices and practices to put lives and property at risk. 

6)    There is no tracking of fires, no coordination among/between agencies,  and no central authority with responsibility for oversight.

7)    The public is being given false, incorrect information.

According to evidence that I obtained directly and provided in my fire report, Mr. James has been misled with regard to procedures that BC Hydro follows.  It is imperative that he read the complete report, review the evidence, and consider that BC Hydro has allowed him to provide erroneous and irrelevant comments.

Mr. Wruck, I am still waiting for a response from the BCUC regarding the charges I made regarding the Commission’s  failure to protect the customers of BC Hydro, which is required under the BC Utilities Commission Act.  I look forward to receiving it at your earliest convenience.

         British Columbia Hydro and Power Authority (BC Hydro)  

         Response to Commission Request for Comment on Ms. Noble’s

         Correspondence

BC Hydro writes in response to the British Columbia Utilities Commission’s email request dated September 18, 2017 to review and provide comment on Ms. Noble’s correspondence. Much of the material provided by Ms. Noble has been considered and reviewed in previous submissions on this matter to the Commission. BC Hydro has  reviewed Ms. Noble’s report (the Report) and provides further comments below. 

Background 

On July 16, 2015, Ms. Noble filed a complaint with the BCUC alleging that smart meters installed by BC Hydro and FortisBC Inc. are fire safety hazards. On October 29, 2015, the Commission staff requested information from FortisBC Inc. and BC Hydro related to the safety of smart meter implementation, indicating the information would be used to address customer concerns or would be used for Commission staff reporting to the Government. We provided our responses on November 30, 2015 and upon Commission staff clarification of question numbers 2 and 3, provided a further response on February 9, 2016.

The Commission concluded its review and forwarded a draft report to BC Hydro for comment on February 12,  2016. BC Hydro responded with corrections and requests for clarification and further comment on March 4, 2016.  BC Hydro further amended its November 30, 2015 response in a March 18, 2016 letter to the Commission following a review of two BC Safety Authority reports received from the Commission on March 10, 2016.

The Commission issued a decision on July 28, 2016 (the Decision) and ordered BC Hydro and FortisBC Inc. to report all incidents where a meter and/or meter base is reasonably assessed to be the possible or likely source of a high temperature or fire event that results in the meter and or meter base requiring replacement. The reporting was to begin immediately and continue until December 31, 2020 on a semi-annual basis. BC Hydro has submitted two reports in compliance with the order, Compliance Report No.1 submitted on January 30, 2017 for the period July 1, 2016 to December 31, 2016, and Compliance Report No.2 submitted on July 28, 2017 for the period January 1, 2017 to June 30, 2017.   

BC Hydro Comment 

BC  Hydro notes most of Ms. Noble’s contentions and assertions in the Report have been the subject of, and addressed in, previous submissions and responses. BC Hydro declines to provide any further comment on information that has already been provided, and reviewed and addressed by the Commission in its draft staff report or its Decision. BC Hydro also declines to provide comment on assertions made by Ms. Noble that are directed towards other agencies.  

As noted above, the Commission has established a process for the ongoing reporting of incidents on a semi-annual basis over a three-year period that should provide sufficient information to the Commission to find that smart meters are a safe and reliable means of measuring electricity use. BC Hydro is of the view that the Commission’s  Decision addresses Ms. Noble’s concerns, and that no further process than that already directed by the Commission is required at this time. 

Ms. Noble’s report is structured around four contentions. Contentions No. 1 to No. 3 primarily relate to Mr. Garis’  Study, so BC Hydro reached out to Mr. Garis for comment. Mr. Garis provided a letter, which BC Hydro includes as Attachment A. 

With respect to other issues raised within the Report, BC Hydro adds the following brief comments and clarifications: 

(i)    Under contention No. 1, Ms. Noble refers to BC Hydro’s attendance and actions at the site of a fire incident. For clarification, when called to a fire and/or electrical incident site, BC Hydro crews work with the emergency personnel to ensure the site is safe. The incident is recorded in the applicable reporting systems with descriptions of the incidents and pictures, if possible. Any meter that is involved in a fire and/or electrical incident is only removed from the site if permitted by a fire incident commander. The meter may be retained by the fire department and recovered by BC Hydro at a later date. Removal of the meter, or recovery of the meter, follows a process where the meter is tagged, boxed, and transported to the meter shop for testing and/or recycling, quarantining, or disposal. As noted in Compliance Report No. 1, in July 2016 BC Hydro formalized its longstanding process for the handling of meters involved in a fire and/or electrical incident by introducing a chain of custody process for tracking returned meters. 

Ms. Noble suggests in her Report that meters involved in fire and/or electrical incidents are sent to BC Hydro’s Powertech Lab1. It is not BC Hydro’s policy to send meters involved in fire and/or electrical incidents to Powertech Labs for testing. The use of the term “labs” in the context of Ms. Noble’s comments refers to BC Hydro’s meter shop;

(ii)   Throughout contention No. 4, Ms. Noble raises general safety concerns. BC Hydro has installed nearly two million Itron smart meters since 2011. In addition to providing billing registers, smart meters provide benefits that improve safety. For example, in a one-year period, smart meters helped identify 258 potentially overloaded services and 192 voltage anomalies, which allowed BC Hydro to take appropriate action; 

(iii)   Ms. Noble has identified 104 incidents included as Appendix W of the Report. BC Hydro has done a review and identified that of the 104 incidents:  

(a)  69 incidents were considered in the data addressed in the November 30, 2015 BC Hydro response and BC  Hydro’s Compliance Report No. 1; 

(b)  Nine incidents are not within BC Hydro’s service territory;

(c)  Two incidents have no corresponding records in any of our systems, therefore we cannot comment; and 

(d)  For the remaining 24 incidents, all of which occurred prior to July 1, 2016, we conducted a review of the available information and applied the same criteria used for current compliance reporting. The results are presented in the following table: 

 

 

(iv)  Under contention No. 4, Ms. Noble discusses the industry standards applicable to smart meters. BC Hydro provides the following comments and clarifications:

ANSI C12 Certification 

All meters, regardless of technology, have been and continue to be, designed, manufactured, and tested in accordance with the same American National Standards Institute (ANSI) C12 series of standards. All smart meters, electronic meters, and electromechanical meters must meet the same standard. BC Hydro has met the ANSI C12 series of standards for every Itron smart meter type that has been installed. BC Hydro also has documents signed by a Canadian registered Professional Engineer confirming compliance with the ANSI C12 series of standards. 

In 2010, to confirm the integrity of the smart meter service disconnect switch, BC Hydro (in conjunction with other utilities) sponsored an independent evaluation of the entire competitive, commercially available smart meter service disconnect switch. This evaluation was performed by the National Electric Energy Testing, Research & Applications Center and confirmed the performance capability of the Itron smart meter service disconnect switch.

Underwriters Laboratories (UL) 2735 Meter Safety Certification  

Due to requests from regulators and consumer groups, the Underwriters Laboratories published the UL 2735 Meter Safety Certification Standard in 2013. The standard was described in a press release as containing: “requirements for the electric shock, fire, mechanical and radio-frequency (RF) emissions safety aspects of all electric utility meters, including smart meters, and is the foundation for both the UL product safety certification service and the  product safety testing service”.  Smart Meter Service Disconnect Switch certification requirements are included in  the UL 2735 certification standard. 

Itron has received UL 2735 certification for the energy only smart meters used by BC Hydro (see link). In order to achieve certification, no modifications were required to the energy only meters that BC Hydro began purchasing in 2011. As a result, all of BC Hydro’s C2SOD and CN2SOD smart meters now have a UL 2735 meter certification by an independent third party. BC Hydro is working with Itron to indicate this UL 2735 certification on the energy only meter nameplate. 

A Canadian version of the standard, UL 2735C is being developed and is currently posted for public consultation (proposed UL 2735C standard). BC Hydro is a founding voting member of the UL 2735C committee; 

(v)   With respect to comments in the Report about the location of meter sockets, the Canadian Electrical Code permits customers to install their meter socket on the line-side of their service disconnect box. The choice on where their meter socket is physically located is up to the customer. BC Hydro’s safety design requirements are that the customer meter socket be installed on the load side of the customer’s service box where the available fault current exceeds 10,000 Amperes; and

(vi)  With respect to a request in the Report for the Commission to order the removal of the Itron smart meters and replace them with analog meters, BC Hydro notes that electromechanical (analog) meters have not been manufactured in North America since 2010 and have not been purchased by BC Hydro since 2002.

This report has recently come to my attention and has made reference to a number of studies I have conducted including the entitled; “Safety of Smart Meter Installations in British Columbia: Analysis of Residential Structure Fires in BC between July 2010 and June 2015.” The analytical study(s), five in total have been conducted for five consecutive years commencing in 2012 and ending in June 2016.

The report by Ms. Noble provides commentary on some of the methodological aspects in the study(s) that I have conducted which are misleading.

Ms. Noble is stating that the sole source for the study(s) is the Fire Commissioners Annual Statistical Fire Report (“the Statistical Report”), and “made serious error by not reviewing the actual incident reports and learning that fires that were reported fit his definition of a like smart metre fire: fires on exterior walls, involving panels: fires where the igniting object was Electrical Distribution Equipment, Fuel was electricity, Form of Heat was Electrical.” Stating the information is incomplete and erroneous. 394

The Study(s) in fact examined 39,928 records in its last publication and retained 12,208 that were residential fires in nature, these records contain a complete description of the fire, nearly 78 fields of information such as date, time, location (community name) nature, fuel or energy, source of ignition etc. or as referenced, used the Fire Commissioners raw data. Further the records obtained represent 394 separate communities’ submissions. The demographic included Aboriginal Bands, Municipal areas, Non-municipal areas with fire support and Non-municipal areas without fire support.

The BC Government fire reporting system is designed to provide a methodology for the determination of the cause of the fire. In this study the approach was developed to isolate the aspects most likely to capture electricity as a source of heat and fuel then isolate the location of the fire to the electrical distribution equipment (panel and or exterior wall).

Ms. Noble is stating that exemptions are allowed for reporting purposes, for fires that occurred on Aboriginal or Federal Land and that any such fires are not included in the report.

The study included reports from aboriginal lands; Table 1 (Frequency of Fires from reporting Area) titled First Nations Band Area.

Ms. Noble is stating despite a legal requirement, a significant portion of the incident reports were not submitted to the Fire Commissioner.

The current study makes reference “In September 2016, the dataset from July 2010 to June 2012 was revisited, capturing an additional 1,102 fires previously not reported at the time of the initial review.” I believe there are reports that have lagged in reporting that in subsequent years have been captured as lagging reports and are filed as noted in the observation contained in the studies. 

There are numerous references and characterizations that deserve a more detailed review and comment to correct inaccurate statements, however the core aspects of this study impacted are addressed but note, I have not concluded closure to my comments, which may occur at another time.

Finally, the methodology used in this study conducted for the five consecutive years has not been able to demonstrate evidence that electricity or electrical distribution equipment has been a source of ignition or an area of fire origin resulting in fires that have showed to be increasing in British Columbia .

1)    In the Times Colonist, Dermod Travis of Integrity BC wrote about the supposed cuts at BC Hydro that would result in lower rates, etc.  BC Hydro has not been honest about the costs incurred in various deals, and I wrote to Mr. Travis about many that he did not include that are specific to smeters.  My letter is below and I have copied it to the Times Colonist as well.

It seems that her work is more invaluable than ever before to the industry.”

4)    At the University of Canberra, Australia,  the Centre for Internet Safety published a report saying that there have been few benefits realized from smeters and the costs far out-weigh them, plus the risk of hacking is high. This report also discusses many smeter-related topics, e.g. compares one-way transmitters and two-way (the first lasts about  15 years, the second about 8), the privacy issues and goes into great detail about data being gathered. It  is a very interesting report, a fast read.

I appreciated your article in the Times Colonist on Nov. 4.  It is high time that BC Hydro financial “miscalculations” were brought to the public’s attention.  I would like to add a couple of other results of “cost-cutters” that have been hidden, and, in fact, about which BC Hydro and the Liberals refuse to speak:

1)    Smart meters in the initial business case were said to have a 20 year lifespan. Even if this were true it would be half the lifespan of the simple analogs we’ve had for decades. But, being plastic computers, the industry estimates that the average smart meter’s life span will be 5-7 years  (https://smartgridawareness.org/2015/10/29/smart-meters-have-life-of-5-to-7-years/).  I have asked the former Liberal govt,  BC Hydro and the BC Utilities Commission where this discrepancy is accounted for, but so far have never received a response.  From what I’ve been able to learn, there is no contingency fund for this mis-calculation. At some point in the near future, we will be paying for 2-3 smart meters at the same time.

2)    Analogs required little maintenance, being simple electro-mechanical meters made of long-lasting metal and glass. Smart meters, being computers, require ongoing upgrading and software replacement.  Were these costs taken into consideration in the financial projections?

3)    The smart meter program was projected to cost $1 billion, which would include smart meters on 1.8 million homes. Simply calculated, this comes to $555 per meter. Using the same simple methodology assuming the same infrastructure changes are required, BC Hydro’s costs are the highest I’ve found in North America,  double and triple the costs in other jurisdictions.  (http://www.stopsmartmetersbc.com/wp-content/uploads/COSTS-ON-A-PER-METER-BASIS.pdf)  Why are we paying so much for the same program?

4)    The smart meters are combustible, being made largely of plastic. Many engineers have warned that there are design flaws which cause them to be fire hazards. Because they are not consumer products, CSA does not certify them. And because of various loopholes in our provincial regulations, BC Hydro does not have to have them certified by a professional engineer, as other Hydro-owned equipment must be. As a consequence there have been many failures and fires causing damages. http://www.stopsmartmetersbc.com/bcuc-smart-meter-fires-the-failure-to-protect/  Hydro has paid directly for some that I have documented but there may be others. In other instances insurance companies have paid the claims but, via the subrogation clause which is standard in all policies, the costs can be recovered from the party found to be responsible for the fire. Victims have been told by their insurers that they will be subrogating against Hydro. Where are all of these costs in their financial accounting? Where are the legal costs if the subrogation has been disputed?  I have looked and cannot find them.

5)    A major future cost is for improved security. Currently cybersecurity experts warn that smart meters are the most vulnerable part of the power grid, an easy entry point for hackers. Calls are being made for improved security, which will be expensive. There is no contingency fund for these expenses, which will be significant.

6)    Many people do not want to have a combustible device that emits microwave radiation on their homes and have “opted out”.  Under the “meter choice” program, a small proportion of those disputing this were allowed to keep their analogs, temporarily. The cost is $32.40 a month, or $64.80 per billing period. This is the highest in North America, and we have never been given complete explanations to support them. In many places the costs are mere fractions.  And for those who are not able to keep their analogs and wish to have the transmitter disabled, the cost is $20 a month or $40 a billing period. Even FortisBC is lower, charging $9 a month for the same service. http://www.stopsmartmetersbc.com/wp-content/uploads/OPT-OUT-FEES.pdf  I estimate that, over the last 4 years, BC Hydro has been paid more than $20 million in these extortive fees, yet no accounting of fees paid or costs incurred has been made available to the public.

Mr. Travis, these are just a few problems with the smart meter program. All of these issues have been brought to the attention of the NDP, Liberals, BCUC and BC Hydro. The media doesn’t seem interested in advising the public. Have you any suggestions?

2)   In 2011 an article in Consumers Digest had some interesting insights and predictions about smeters, sadly, most of which seem to be right on, especially the part about politically influential companies foisting these on us.

3)   In Michigan DTE is passing on the same lies that most utility companies are, saying anything to get smeters on homes. And if people don’t accept the lies, the power is turned off. Now that the weather is cooling off, I bet we will see more of this sort of thing.

But DTE says that claim is unfounded. The company maintains radio frequency exposure from a smart meter is far below other common electric devices, including TV remotes.

DTE also says old analog meters use obsolete technology that is no longer supported and must be changed out. Watson says until this issue is resolved, she’s turned to another source to power home – a generator.”

Please find below an email I sent to Mr. Travis in response to his opinion piece. There are so many issues about which BC Hydro and the former Liberal government have been dishonest with the public. Most are financial in nature, but with regard to the smart meter program there are other, more significant issues that relate to the safety and security of British Columbians.

I ask that you help inform the public about these concerns as well as put pressure on the NDP govt. to do what the Liberals refused to do – have this program reviewed by an independent panel which includes some professional engineers.

I appreciated your article in the Times Colonist on Nov. 4.  It is high time that BC Hydro financial “miscalculations” were brought to the public’s attention.  I would like to add a couple of other results of “cost-cutters” that have been hidden, and, in fact, about which BC Hydro and the Liberals refuse to speak:

1)    Smart meters in the initial business case were said to have a 20 year lifespan. Even if this were true it would be half the lifespan of the simple analogs we’ve had for decades. But, being plastic computers, the industry estimates that the average smart meter’s life span will be 5-7 years  (https://smartgridawareness.org/2015/10/29/smart-meters-have-life-of-5-to-7-years/).  I have asked the former Liberal govt,  BC Hydro and the BC Utilities Commission where this discrepancy is accounted for, but so far have never received a response.  From what I’ve been able to learn, there is no contingency fund for this mis-calculation. At some point in the near future, we will be paying for 2-3 smart meters at the same time.

2)    Analogs required little maintenance, being simple electro-mechanical meters made of long-lasting metal and glass. Smart meters, being computers, require ongoing upgrading and software replacement.  Were these costs taken into consideration in the financial projections?

3)    The smart meter program was projected to cost $1 billion, which would include smart meters on 1.8 million homes. Simply calculated, this comes to $555 per meter. Using the same simple methodology assuming the same infrastructure changes are required, BC Hydro’s costs are the highest I’ve found in North America,  double and triple the costs in other jurisdictions.  (http://www.stopsmartmetersbc.com/wp-content/uploads/COSTS-ON-A-PER-METER-BASIS.pdf)  Why are we paying so much for the same program?

4)    The smart meters are combustible, being made largely of plastic. Many engineers have warned that there are design flaws which cause them to be fire hazards. Because they are not consumer products, CSA does not certify them. And because of various loopholes in our provincial regulations, BC Hydro does not have to have them certified by a professional engineer, as other Hydro-owned equipment must be. As a consequence there have been many failures and fires causing damages. http://www.stopsmartmetersbc.com/bcuc-smart-meter-fires-the-failure-to-protect/  Hydro has paid directly for some that I have documented but there may be others. In other instances insurance companies have paid the claims but, via the subrogation clause which is standard in all policies, the costs can be recovered from the party found to be responsible for the fire. Victims have been told by their insurers that they will be subrogating against Hydro. Where are all of these costs in their financial accounting? Where are the legal costs if the subrogation has been disputed?  I have looked and cannot find them.

5)    A major future cost is for improved security. Currently cybersecurity experts warn that smart meters are the most vulnerable part of the power grid, an easy entry point for hackers. Calls are being made for improved security, which will be expensive. There is no contingency fund for these expenses, which will be significant.

6)    Many people do not want to have a combustible device that emits microwave radiation on their homes and have “opted out”.  Under the “meter choice” program, a small proportion of those disputing this were allowed to keep their analogs, temporarily. The cost is $32.40 a month, or $64.80 per billing period. This is the highest in North America, and we have never been given complete explanations to support them. In many places the costs are mere fractions.  And for those who are not able to keep their analogs and wish to have the transmitter disabled, the cost is $20 a month or $40 a billing period. Even FortisBC is lower, charging $9 a month for the same service. http://www.stopsmartmetersbc.com/wp-content/uploads/OPT-OUT-FEES.pdf  I estimate that, over the last 4 years, BC Hydro has been paid more than $20 million in these extortive fees, yet no accounting of fees paid or costs incurred has been made available to the public.

Mr. Travis, these are just a few problems with the smart meter program. All of these issues have been brought to the attention of the NDP, Liberals, BCUC and BC Hydro. The media doesn’t seem interested in advising the public. Have you any suggestions?

1)    The smeter resolution did not make it to the floor at the NDP convention. Very few resolutions did in what was a very tightly controlled convention, apparently. But thanks to the efforts of people handing out flyers, talking with delegates both outside and inside the Conference Centre, some attention was given to the resolution in the Times Colonist today:

2)    A member found 2 excellent letters that were written by very knowledgeable people in Maryland with regard to proposed microcell transmitters and 5G:

“…the scientific evidence suggests that we must treat radiofrequency radiation, and in particular cellular radiation, not only as dangerous to health generally, but also as a CARCINOGEN that is dangerous to life itself. And, there are laws against assault. Further, since that assault can result in death, those people must be considered as under “assault with a deadly weapon”.  That is also against the law.  Furthermore, if any of those people die as the result of that assault, that is “murder”.  Murder is also against the law.


So, it seems fair to ask this question:  Is the 1996 Telecommunications Act so powerful that it overrides the laws against assault, assault with a deadly weapon, and murder? I doubt very much that the authors of the 1996 Telecommunications Act, in their zeal to promote the rapid expansion of cellular technology without prior testing for safety, intended to convey a right to the telecommunications industry to assault, and even kill, people.

If County officials want to protect the public from harm, they need to rally their legal might to resist ALL EFFORTS to install small cell towers in the County, not just because that is the right thing to do, but also because such installation violates multiple existing laws that are reasonably believed to be preeminent.”

“Suppose the Federal government passed a law stating that herbicides could be sprayed over populated areas by contractors, and these sprayings could not be opposed for health reasons.  If a local company wanted to initiate daily sprayings of Agent Orange over Montgomery County, would the members of the County Council allow it, despite what the law stated?  Would the residents allow it, despite what the law stated?  I suspect there would be an armed insurrection to block the spraying.  Yet, cell tower developers are proposing to ‘spray’ a highly toxic substance (non-ionizing radiation in RF bands) over Montgomery County, and the decision-makers act as if they have no options.”

3)    Another member found this website which has this interesting article about physicists, many of whom work for the telecom industry and are said to be experts on wireless radiation, even though most have no knowledge whatsoever about the biological effects of non-ionizing radiation.  Good info to have when someone quotes a physicist and tries to use him/her to say that microwave radiation is ‘just fine’.

Fighting the site C dam and corrupt BC Hydro band of thugs! Posted Nov 5/17

1)    Re. NDP convention” We are meeting at 8:15 am outside the Convention Centre, 720 Douglas St., Victoria.  We will have flyers to hand out. Hope to see you there. (unless a snowstorm prevents us from getting down our “mountain”.  It is snowing hard in Victoria as I write this.)

2)    There were 2 major programs that were exempted from oversight by the BC Utilities Commission by the Clean Energy Act 2010: Site C and Smeters. Now that the report from an independent review confirms that BC Hydro was irresponsible financially and with projections re. need, it’s time for a similar independent review of the smeter program. We should continue to pressure Horgan and Mungall and all MLAs for this review, but also the Greens who hold power over the NDPs status in govt. I am not convinced that Weaver would understand or support concerns about health (he told a constituent that “as a scientist” – he taught climatology – that RF is safe and incapable of doing harm), but he seems to be concerned about costs and perhaps he will care about security and fires. BCUC Report Puts Final Nail in Site C’s Coffin

“Jefferson County Public Utility District officials agreed to discuss potentially halting the rollout of new “smart meters” after a public meeting in which community members expressed health and privacy concerns as well as unease about the cost and longevity of the new meters.

The meeting Monday night lasted roughly three hours, with more than 100 community members in attendance, many of whom stood or sat on the floor in the Chimacum Fire Hall.”

I realize that you are busy as a new MLA, but I am hoping that, as an activist and being more independent than most MLAs, you would take an interest into the issue of the smart meters that concern so many people.  I would appreciate if you would acknowledge receipt of the fire report binders that I mailed to your office 2 months ago.

Smart meters concern all of us, whether we know it or not. The problems are many and varied, as I said below. But one issue that I did not identify for you is the cost that many are paying just to protect themselves and their families: the opt out fees.

BC Hydro customers who have been able to keep their analogs for the time being are charged $64.80 per billing period, or $32.40 a month. These are by far higher, in some cases multiples, of the fees charged in other places for the same service.  Why? Is BC Hydro that much less efficient?  Even within our province, BC Hydro customers who are allowed to have a smart meter with the transmitter disabled pay $20 per month when FortisBC customers pay $9.  According to the BC Utility Commission Act, BC residents are not to be discriminated against, but yet we are.

Did you know, Ms. Furstenau, that many people are paying more for the opt out fee than they are paying for electricity? And this is when they may have neighbours whose smart meters must be read manually because they are not working. No additional travel or time is needed to read the analog.  According to BC Hydro, more than 50,000 smart meters are read manually without additional cost. It appears that we are subsidizing BC Hydro’s poorly designed and implemented program.

BC Hydro has collected in excess of $20 million in opt out fees yet has never provided a public financial accounting to show the costs incurred or the amount collected.

We the public need someone with your dedication to support us.  I hope you will accept this challenge.

Next week you will receive a box containing 2 binders with a report and evidence gathered over the last 3 years, entitled “BCUC & Smart Meter Fires:  The Failure to Protect”.  The report has been delivered to Premier Horgan’s constituency office and mailed to Mr. Morton, CEO and Chair of BCUC.  The covering letters are attached above.

I would ask that you and your staff give serious consideration to the incidents documented and to the failure of BC Hydro to take appropriate actions to ensure that the smart meters are safe. After 3 years of asking, I still have not received confirmation that this device was inspected and found safe by a professional engineer at BC Hydro.  This alone speaks volumes to the failure to BC Hydro to exercise due diligence with regard this equipment which has been put on homes.

In addition, the report contains evidence that rules and regulations are being ignored, and that the Office of the Fire Commissioner is not reporting or tracking fires as intended. Neither are electrical fires being inspected according to the BC Safety Standards Act. With the information available to the officials, it is impossible for them to know that the smart meters are failing, burning and putting the lives and property of British Columbians at risk.

This is a matter that is of vital importance which the previous government caused and refused to acknowledge. The smart meter program, as you may know, is fraught with problems ranging from health (radiation being emitted), to security (data can be gathered and in many places is being shared and sold), to cybersecurity (many experts warn of accidents or attacks bringing down the grid via the smart meter), to costs (these meters have a 5-7 year life expectancy, benefits have never been sufficient to justify the costs). But safety is one problem that cannot and should be delayed or ignored any longer. The consequences are too great.

Ms. Furstenau, I know that you are as concerned as I about health and safety. I ask that you join with me in demanding that this program and these meters be recalled for the sake of all British Columbians.

1)    Someone from Massachusetts sent this warning re. digital thermometers:

“I purchased a new digital thermometer this week at CVS – the inexpensive model – and in reading the instructions inside the packaging, I came across some disturbing information. Under the FCC heading, the information said something like: 

“This product transmits, receives and uses radiofrequency signals that can interfere with other radiofrequency electronics.” I promptly returned the thermometer to the store. 

So, the Internet of Things has made its way into digital thermometers. Thought you’d all like to know.”

2)    The new Gov. General of Canada is a former astronaut and wants science, real science, to be emphasized, and to shut down bogus (industry biased) “alternative facts”, like those Health Canada use to establish policies.   This is very encouraging and hopefully Gov. Gen. Payette is already knowledgeable about microwave radiation. Hopefully really credible experts, like Devra Davis, will encourage Payette to push for real science in Health Canada.

3)    Premier Horgan plans to meet with Hydro in early 2018 to discuss rates, etc. Let’s pressure him to include discussion of opt out fees, both by those of us who still have analogs and those with transmitters turned off.   And why has there been no financial accounting of the extortion fees over the last 4 years, both how much taken in and what “additional” services cost.  How can someone who has an analog and lives next door to someone with a non-functioning smeter require additional services that cost $64.80 per meter read? Impossible. And why does FortisBC charge $9 per month to those with smeters with the transmitter turned off and Hydro charges $20?  Ask Hydro to justify that!!  And that is just the beginning of the smeter issues that Horgan should be discussing with Hydro. Another “hot” topic is fires.

Province to meet with BC Hydro over pricing, billing

The premier of B.C. says his government will be meeting with BC Hydro officials in the new year to discuss a number of issues including deferred debt, the steady increase in electricity pricing and also the much maligned two-tier billing process.

Speaking to reporters this week, John Horgan acknowledged a “host of issues” at BC Hydro and levelled his criticism at the former governing Liberals who he says had left the crown corporation “far from under control”.

          I received your update re the BC Hydro Site C project and am in agreement with your rational argument and pleased that you are perseverant in requiring a thorough and transparent public evaluation of this project , a project that should have been vetted by the BCUC from the outset!

          Also, as I have said to you before, I am very upset with the scandalously deceptive, ridiculously expensive, demonstrably unnecessary, potentially dangerous, criminally insecure, and dictatorially implemented “smart” meter fiasco. I would hope that you would agree that a transparent, public review by the BCUC is justified with this boondoggle, too.

“Usurping local control over tower installation has been a cardinal principle of the telecom industry for over 20 years. Section 704 of the 1996 Telecommunications Act preempts state and local government regulation for the placement of wireless antennas on the basis of environmental and health effects. 5G standards are still in development by industry. Nobody knows exactly what frequencies will be used, or what powers will be required to make 5G’s Internet of Everything vision a reality.

The history of public health is littered with examples where economic interests trumped scientific advice. Warnings about the potential dangers of lead in gasoline, X-rays in pregnancy, and the dangers of tobacco were all swept aside by industry interests who gained millions from these unwise products and unhealthy practices. It was only after we had irrefutable evidence of sickness and death tolls that we got rid of these hazards. Could 5G be the next asbestos?…

…the National Toxicology program found wireless exposed rats developed cancer and DNA damage. Millimeter frequencies have been found to accelerate bacterial growth, and when combined with antibiotics, they have an even stronger effect. Israeli scientists found that 5G’s higher frequencies are preferentially absorbed in the sweat duct, acting like helical antennas that send and receive microwave signals.

These millimeter frequencies are used by the U.S. Department of Defense as a crowd control weapon, known as Active Denial Systems. 5G frequencies have the capacity to make skin feel that it is burning. Beam this frequency at a crowd, and people flee. Is this something you want on your lamppost?”

2)    Below is a letter from Min. of Energy Mungall written to a member who wrote expressing concerns about the smeters and the program. She responds with the same false, inaccurate info that Coleman and Bennett provided when they were in that office. I know she’s new and busy, but there are a whole lot of highly paid people who should be educating her on important issues.  With the permission of the member I responded.  I expect she won’t read my letter either, but it will be interesting to what response I do receive.

Dear Hon. Minister Mungall,

Mr. X shared with me the response he received from you regarding his concerns about smart meters, and I hope that you and/or your assistants will consider my comments.

I understand and appreciate fully that you are new to your position and have other priorities with which you are dealing. Nevertheless I find it unacceptable that the information in your response is simply a parroting of that used by your immediate predecessors, which had been given to them by industry and BC Hydro.  The smart meter issue for which you are now responsible is significant, one that deals with many problems, some of which have the potential to cause harm to health, life and property and warrants serious investigation.  It is vital that you look beyond this “canned” information, so that you can, as you state, be informed in your role as Minister of Energy.

I am writing to you and commenting on statements in your email in an effort to offer information that I have learned through many years of research.

1)    All electricity meters must pass federal and North American standards set by Measurement Canada, the American National Standards Institute, the Institute of Electrical and Electronics Engineers and the International Electrotechnical Commission.  All BC Hydro meters comply with the applicable standards.”

All these standards relate to accuracy and compatibility only.  There is nothing in these standards that applies to fire safety.

2)    “The Canadian Standards Association (CSA) standard, to which you refer, applies to consumer products.  Requirement for CSA certification does not apply to smart meters, including analog and digital meters, as these are utility owned and operated equipment.  Itron, the meter vendor, requires that materials used in its meters (for example, plastics used in the meter bases and covers, insulation materials) from third-party suppliers conform to specific UL (Underwriters Laboratory) standards for flammability and other safety requirements.”

ITRON meters were not certified by UL prior to having been installed.  According to BC Hydro’s information that was given to me (please see my report “BCUC & SMART METERS: The Failure to Protect” for documentation) they accepted ITRON’s protocol for safety. No documentation has been provided by BC Hydro or ITRON after several requests.

A related point is that  the bases on which these meters are mounted belong to the homeowner. They are certified by CSA but only for analog meters. Thereforeconsumer owned bases must not used with combustible, digital smart meters. 

Further, the UL protocol is not adequate in that it does not include testing of what professional engineers consider to be the most dangerous component of the smart meter – the remove disconnect switch. (Reference: William Bathgate, page 29 of my fire report).  Obviously you are unaware that smart meters that were certified by UL were found to have caused fires.  The very same Landis & Gyr smart meter that caused fires according to legal testimony (http://www.stopsmartmetersbc.com/wp-content/uploads/2015/05/Reed_Answering_Brief-1.pdf ) was later certified by UL.  Obviously UL’s protocol 2735 is not adequate to ensure that these devices are safe.

No independent certification of ITRON’s  smart meters (including the remote disconnect switch)  has been done BC Hydro uses a loophole in the BC Safety Standards Act which says that “regulated” Hydro equipment must be certified by an electrical engineer licensed to work in BC. But BC Hydro considers smart meters “unregulated” and, therefore, they do not have to be certified by any independent professional engineer.

If a device owned by BC Hydro is put on homes, it should be required that every possible precautionary step be taken to ensure safety. To do otherwise is woefully and wilfully negligent. The current law with its loophole is putting lives at risk and must be changed.

3)    Regarding your concern that smart meters are a fire safety hazard in British Columbia, the BC Utilities Commission (BCUC) responded in July 2016 to this concern as a result of customer complaint to the BCUC (see BCUC Document G-126-16 online at http://www.ordersdecisions.bcuc.com/bcuc/orders/en/item/168896/index.do).  Based on the data before the BCUC during the complaint process, the BCUC found “no evidence that smart meters materially increase the risk of fires in BC over analog and digital meters.”  However, the BCUC directed BC Hydro and FortisBC to report on a semi‑annual basis to the BCUC regarding “all incidents where a meter and/or meter base is reasonably assessed to be the possible or likely source of a high temperature or fire event that results in the meter and/or meter base requiring replacement.”

The complaint to which you refer was made by me.   BCUC found no evidence of increased risk of fire because they didn’t look. They told me it was up to me to find it. I did and it is in my report “BCUC & Smart Meters: The Failure to Protect”  (Appendix A) The basis for BCUC’s “decision” was faulty.  It was as a result of my complaint that BCUC instituted temporary measures requiring incidents involving a smart meter to be reported by BC Hydro and FortisBC.

On Sept 2, I mailed to your office a box with 2 binders (700 pages) with a report (38 pages) and evidence refuting BCUC’s assertion that smart meters are just as safe as analogs. To date I have not received a response from you or your office. The evidence upon which BCUC bases its conclusion is faulty, based on incomplete information. Nearly half of the fires that I investigated involved or were suspected to have involved a smart meter. BCUC depended solely on Len Garis’s assertion that there had been no smart meter fires. Yet, using Garis’s own criteria for identifying smart meter fires, I found 47. I found them by looking at raw data which was ignored by Garis and BCUC.  The assurance you’ve given above is word for word the same one that the Liberal Energy Ministers gave. Based upon the report that you have in your possession, it is unacceptable that this be repeated.

Independent professional electrical engineers, both from BC and from the US, have provided details about the smart meters that make them to be fire hazards. No one, not BC Hydro, not BCUC, and not the Energy Minister’s Office is taking this information seriously. Rather lives and property are being put at risk. Many smart meter failures and fires have occurred and are being ignored. 

4)    “On December 21, 2016, BC Hydro filed with the BCUC, further to BC Hydro’s Fiscal 2017 to Fiscal 2019 Revenue Requirements Application (RRA), the “Smart Metering and Infrastructure Program Completion and Evaluation Report.”  This Report includes a review of health, safety and personal data security concerns, and updates the BCUC on responses to these matters, which you might find informative, as they relate to several of the concerns you identified in your email.  The Report can be found at http://www.bcuc.com/Documents/Proceedings/2016/DOC_48502_B-1-4_BCH-Appx-P-Update-SMI-Report.pdf (see pages 19 to 23 of 74).”

The “review of health” in the Fiscal Report merely states that the level of microwave radiation is within the limits established by Health Canada. There are no limits established by Health Canada that apply to microwave radiation that is emitted by smart meters. The limits apply to thermal radiation only, the type that harms by heating. 

There are thousands of studies showing that biological effects occur at levels far below those allowed by Safety Code 6. Obviously you do not know that microwave radiation like that emitted by smart meters has been classified by the World Health Organization as a 2b carcinogen.  This is the same classification as DDT and lead. We cannot use DDT on our lawns or lead in paint, so why should microwave radiation be considered safe when it is shooting into our homes 24/7/365?  Many people have sent you and your office scientific studies which refute the statement you’ve made above. I predict that BC Hydro, this governmentand,  perhaps, even those individuals in charge who are willfully ignoring evidence will be held financially liable when lawsuits are filed for health problems caused by smart meters.

5)    “With respect to your concerns about meter exchanges required due to the expiry of the Measurement Canada seal, the legacy meter charge, service disconnection without notice, and reconnection charges, I note that BC Hydro must abide by the BC Hydro and Power Authority Electric Tariff.  The BCUC sets out the terms and conditions that apply with respect to these matters.  The Tariff is available online at https://www.bchydro.com/content/dam/BCHydro/customer-portal/documents/corporate/tariff-filings/electric-tariff/bchydro-electric-tariff.pdf.

The BCUC is responsible for overseeing BC Hydro and ensuring compliance with the Tariff.  If a customer has a complaint concerning BC Hydro’s compliance with the Tariff, the customer may seek assistance from BCUC’s Utility Customer Complaint Process by emailing the complaint directly to complaints@bcuc.com

Minister Mungall, as the person responsible for BC Hydro, I am surprised  that you are not aware that the BCUC has been put into a position where it cannot interfere with the smart meter program. Both the Clean Energy Act of 2010 and Direction 4 remove BCUC’s responsibility for oversight.  BC Hydro has offended people, bullied seniors, and misinformed customers without ramification.  The Liberal party eliminated any recourse for maltreatment or concerns that, according to the Charter of Rights and Freedoms, have been infringed upon.  You and the NDP could change this if you have the will.

6)    “According to the terms and conditions of the Tariff, effective April 1, 2017, the standard monthly legacy meter charge is $32.40 (see page 11-3) and for “manual reconnections at the Point of Delivery because the Customer failed to provide access to the meter,” the minimum reconnection charge is $700 per meter (see page 11-2).

The BCUC assessed the appropriateness of these charges relative to incremental costs before setting these charges.  The extra costs that the utility is bearing to serve customers with an analog meter are being charged to customers that choose to retain an analog meter.  Similarly, the incremental costs associated with a manual service disconnection and reconnection are charged to the customer causing these costs.”

The opt out fees paid by those who have wanted to keep their analog meters as long as possible are the highest in North America, often 200-300% higher than in other jurisdictions. Why? BC Hydro has never provided an annual financial accounting for these fees, showing how they are spent. Neither has BC Hydro explained why meter reading is being charged again when the rates already include this “service”.  And why people who elect to have a smart meter with the transmitter turned offare charged $20 a month vs. FortisBC’s charge of $9?  Is BC Hydro that much less efficient? As many as 50,000 homes have smart meters that are not functional and are being read manuallyThese homes are requiring the same service as a home with an analog, yet no additional charge is levied. If the smart meter that is non-functional is beside a home with an analog, there is no additional travel and minimal time required, yet no reduction is offered. Clearly the opt out fee is punitive which is against the BC Utilities Commission Act that says all customers must be treated fairly and consistently.  Some might call such “fees” extortion.

7)    “I understand that smart meters have a minimum life expectancy of 20 years.  Like any electronic equipment, some of those meters will need to be replaced over time.  BC Hydro anticipates having to replace 10,000 smart meters a year (out of a total of 1.93 million smart meters) for the next four years through normal course of business: broken screens, software upgrades, and exterior damage.  These replacements are covered under warranty with the meter vendor.”

You have been misinformed, as were the BCUC and the public. The expected life expectancy of a smart meter is 5-7 years. This is admitted in Congressional Testimony by a Senior Vice President of First Energy, a major US utility company. https://smartgridawareness.org/2015/10/29/smart-meters-have-life-of-5-to-7-years/  It must be remembered that these “smart” meters are merely plastic computers.

Min. Mungall, you have in your possession sufficient information, studies and reports to help you “inform my work within the Ministry of Energy, Mines and Petroleum Resource.” You have, in my Fire Report, all the information you require to make an informed decision about the safety of these meters, including testimonials by independent professional electrical engineers.

It is imperative that you and your staff become educated on this topic and stop providing the canned responses provided by your predecessors.  The public is looking to the NDP for change in approach, attitude toward the public, and a sense of responsibility unseen in many years. Please, do not disappoint us.

Thank you for taking the time to write on August 27, 2017 and share your views regarding BC Hydro’s Smart Meter Initiative Program.

Modernization of the electricity grid is critical to provide an efficient, secure and reliable power system, including the replacement of obsolete mechanical meters with modern smart meters.  While some legacy meters remain in operation in British Columbia, they are no longer BC Hydro’s standard meter.

All electricity meters must pass federal and North American standards set by Measurement Canada, the American National Standards Institute, the Institute of Electrical and Electronics Engineers and the International Electrotechnical Commission.  All BC Hydro meters comply with the applicable standards.

The Canadian Standards Association (CSA) standard, to which you refer, applies to consumer products.  Requirement for CSA certification does not apply to smart meters, including analog and digital meters, as these are utility owned and operated equipment.  Itron, the meter vendor, requires that materials used in its meters (for example, plastics used in the meter bases and covers, insulation materials) from third-party suppliers conform to specific UL (Underwriters Laboratory) standards for flammability and other safety requirements.

Regarding your concern about the accuracy of smart meters, Measurement Canada requires that all new meters in Canada, including smart meters, operate within a 1 percent accuracy tolerance.  BC Hydro has a much stricter requirement for its smart meters – 0.2 percent accuracy tolerance.  In other words, BC Hydro smart meters are accurate to 99.8 percent.  Out of the 1.9 million new meters installed to date, about one-tenth of 1 percent have problems of any kind (0.1 percent).  Industry experience has shown that, on average, about 0.5 percent of meters can have components that fail early in the unit’s life cycle.

Regarding your concern that customers refusing smart meters are facing service disconnections without notice, I understand that, in these cases where a planned meter exchange is refused or obstructed, BC Hydro attempts to resolve the issue with the customer and makes several attempts to communicate and, where necessary, notify the customer of the risk of potential service disconnection.  A service disconnection would proceed only as a last resort.

Before a planned meter exchange, BC Hydro first sends a letter explaining the purpose of the work and informs the customer of the need for access to the meter, which is BC Hydro equipment.  BC Hydro also invites the customer to call should they have any questions.

If BC Hydro is not successful in completing the work, BC Hydro sends another letter notifying the customer that there was an access issue, or an obstruction, preventing the meter exchange.  BC Hydro requests that the customer call back by a certain date to confirm access in order to exchange the meter and BC Hydro notifies that, if there is no contact in response to this request, service is subject to disconnection.  If no response is received, BC Hydro will attempt to contact the customer by phone after the date indicated in the letter.

If there is still no response from the customer or if the customer refuses to provide access, BC Hydro will send a Final Notice.  This letter explains the customer’s responsibility to provide access to BC Hydro’s equipment and, if access is denied, the next potential step is to disconnect service.  BC Hydro will ask the customer to respond by a certain date and similar to the previous letter, and BC Hydro will call the customer should there be no response.  At this time, BC Hydro also notifies the customer that, before reconnection, BC Hydro will need access arrangements to exchange the meter and the possible charge of $700 for reconnection.

If the customer continually refuses access or refuses to respond, BC Hydro will arrange to disconnect the service.  When the BC Hydro crew is onsite for service disconnection, they will inform the resident, should one be present, that they are there to replace the meter.  If access is still refused, the crew will disconnect the service.  If no one is available at the premises to speak to the crew, disconnection will proceed.

In such cases, disconnection and reconnection of service must be made from the secondary line at the pole (for example, as opposed to disconnecting service at the customer’s meter).  The charge to the customer, therefore, includes the costs associated with disconnection and reconnection performed by a two-man Power Line Technician crew.

With respect to smart meters not performing as expected, though the vast majority of the meters communicate as required, a small number fail due to various factors related to location.  BC Hydro is optimizing the network, so more of these meters will be communicating over time.  Until then, non-communicating meters are required to be read in person by BC Hydro staff.

3)   In parts of California there is an effort to have powerlines put underground to prevent exacerbation of fires by wires and poles. Underground lines would reduce outages due to storm damage to lines and poles, while reducing exposure to EMFs to people living near the corridors. It’s an investment that would cut costs in the long run. If the smeters get recalled, the money that would have been spent on this program could be used to improve the infrastructure in a meaningful way.

5)    More than 170 scientists and doctors from 37 countries ask for a moratorium on deployment of 5G (millimeter wave technology) until studies can determine if there are health and environmental effects.  Having 5G on microcells will increase exposure to RF/EMR dramatically to an environment that is already polluted with microwave radiation that is known to be dangerous.   Please share this with your Council members and Mayors ASAP so that they have this information prior to the UBCM conference starting on Sept. 25.  With this, it should be a no-brainer for them to support the resolution that will be presented.

Are you aware that current federal regulations allow the newest telecommunication technologies, microcells, small cell towers, and 5G transmitters to be placed on existing structures like utility poles without any public consultation?  It is imperative that municipal governments become aware of the aesthetic design, health, and safety implications of these technologies.

At this September’s UBCM you will be invited to vote on a resolution which promotes local authority and public consultation in microcell placement. Why is this important? Microcells lay the groundwork for new technologies to come – 5G, smart cities, and a proliferation of artificial intelligence.

Now is the time for local governments to become equal partners in the shaping of the technological future of their communities, making measured choices that consider local concerns and preserve the public’s right to transparent and accountable government.

Please educate yourself on this issue.  Consider the resolution below.  Draw on the spirit of the theme of this year’s UBCM Convention:  Roots to Results – considering the increasing leadership of local government in matters of federal and provincial jurisdiction, and assert your right, on your constituents’ behalf, to have a say in where microcell towers are located on our streets.

WHEREAS public consultation on the placement of cell towers is mandated; and

WHEREAS new technology is moving away from these large towers to microtransmitters which do not require local government or public consultation;

THEREFORE BE IT RESOLVED that the AKBLG request the UBCM petition relevant provincial and federal governments to mandate consultation with the land use authorities and the public regarding microcell transmitter siting within 100 meters of residences, schools and hospitals

As you are a lawyer, if you have the time I would appreciate your comments as to whether or not the “Notice of Liability” document attached is just pseudo-legal BS.  The website www.inpowermovement.com is promoting the use of such document, but as far as I know it all seems to be based on similar ideas as to those used by the “Freeman on the Land” philosophies.  Courts have ruled such OPCA nonsense to be a vexatious waste of court time.
