Wealthy families that have dynastic dreams now have more options to provide for their progeny. In 2013, the province of Nova Scotia joined Manitoba and Saskatchewan in abolishing the rules against holding assets in trust forever.

The laws banning perpetual trusts caused headaches for families who wanted to pass down assets, says Timothy Matthews, partner at law firm Stewart McKelvey in Halifax. “You could violate the rule without even being aware of it,” he says.

Nova Scotia’s now-abolished Perpetuity Act declared any trust void if it could last longer than 21 years after the last beneficiary died. So, if at any point a trust’s commitments were in danger of being unresolved by that deadline, the trust would have been voided. Such trusts were unwound and their assets reassigned to their original owners or their estates—leaving the original plan in shambles.

“There could be all kinds of income tax consequences,” says Matthews. “There could be people who expected to inherit who were completely disinherited, and the assets could have ended up somewhere other than where the original owner intended.”

Imported from England, the law against perpetual trusts once existed in every province except Quebec. Manitoba was first to abolish it, in 1983, followed by Saskatchewan. Other provinces, including Ontario and Alberta, have reformed their laws to wait and see whether a trust exceeds its 21-year plus life-in-being limit before voiding it, instead of voiding the trust on that mere possibility.

Other provinces have chosen to extend trust validity instead of abolishing the rule; PEI has extended the time a trust can exist to the life of the last beneficiary, plus 60 years.

Note that the 21-year perpetuities rule for trusts is not the same thing as the 21-year deemed disposition for taxes. Most trusts, perpetual or not, must pay taxes as if they’d sold their assets every 21 years. “A perpetual trust could be set up that would last for 210 years, and that would have 10 deemed realizations,” says John Poyser, partner at Tradition Law Estates and Trusts, Winnipeg.

So, families should plan to put at least $5 million into a perpetual trust to make it worthwhile, he says. For instance, the trusts can work for wealthy clients who want to ensure all their heirs can afford to go to university, regardless of cost.

Setting up a perpetual trust

Creating a perpetual trust costs between $20,000 and $45,000, says Poyser. “These trusts, when they’re established, typically run from 30 to 100 pages,” he adds.

The trust should outline what the settlor expects the money to be used for. “I’ll include a provision that talks clearly about how the income and capital is to be used, and the family or societal values that are being carried forward,” he says. “What’s the vision? What’s the goal?”

Choosing a trustee also is a challenge, since the trust will outlive any one person. Clients should use a panel of trustees that can be repopulated, or a trust company, and Poyser says drafters should think even longer term.

“Who says we’re going to have trust companies 150 years from now?” he says. “You’ve got to [build in] a lot of flexibility if [a trust is] truly going to [last] three or four generations.”

So, he suggests appointing a protector in addition to the trustee. A panel of family members can serve as protectors, and the trust could stipulate how to replace deceased members. Those protectors would monitor the trustee’s performance and appoint a new one if the trustee performs poorly or decides to charge too much. “You achieve accountability in the hands of the family,” he says. “Otherwise you say to them,‘Let’s put $400 million in a trust and you guys will kiss it goodbye, because [it’s with] the trust company and you’d better hope they’re going to follow your vision.’ ”

Choosing a jurisdiction

Clients don’t have to live in a province that has abolished perpetuities rules to set up a perpetual trust for investments and other movable property, says Tom Grozinger, principal trust specialist, RBC Wealth Management, Ottawa. But it’s prudent for the trust to have other connections to the jurisdiction.

Poyser says the factors determining trust residency include where trustees reside, where beneficiaries live, where the assets are, whether the trust has a choice-of-law clause and, if the trust is testamentary, where the settlor died. A court will consider these together in a trust-residency challenge. The trust should have as many connections to its jurisdiction as possible. For example, an Ontarian setting up a Nova Scotia trust should pick a Nova Scotian trustee.

Whether that Nova Scotia trust could hold land or a home in Ontario or another province that still has perpetuities rules is unclear, says Matthews.

“There are arguments that the Nova Scotia law would apply to it; there are arguments that Ontario law would apply to it,” says Matthews.

Generally, governments don’t like it when another province’s laws govern their land, he explains. He adds that strategy would be a risk until the courts rule on a precedent-setting case. So, Matthews advises having specific instructions for Ontario land in a Nova Scotia trust. “You’d say the land has to be distributed to beneficiaries within the lifetime of Person X, plus 21 years. That way, that part of the trust wouldn’t violate Ontario rules.”

Alternately, the land could be in a separate trust.

Every perpetual trust should designate the law and courts of a pro-perpetuities place, says Matthews. That protects the trust in a dispute, because it ensures a court familiar with perpetuities applies the updated laws.

“If you had an Ontario court hearing the dispute, they probably would apply Nova Scotia law, but they would consider Ontario public policy too,” he says. “So you’d want to keep it out of their hands.”

Grozinger also recommends using a lawyer who practices in a pro-perpetuities province to establish the trust.

A local lawyer will know whether other laws in her jurisdiction could affect the operation of the trust. For example, each province outlines its own criteria for when trustees may simply resign and when a court must decide whether a trustee can be released from her duties.

Clients with trusts in places with perpetuities laws may wonder if they could move their trusts to Manitoba, Saskatchewan or Nova Scotia so as to automatically take advantage of these provinces’ pro-perpetuities laws. No such luck, says Grozinger.

First off, a trust is a legal relationship, not an object, so it doesn’t move in the traditional sense. And, while trustees may change jurisdictions, it’s not usually possible to change the law governing a trust from an anti-perpetuities province to one without those rules. Instead, a settlor with movable property could create a new inter vivos trust under the law of the new jurisdiction, Grozinger says (testamentary trusts and those with immovable property have different legal considerations).

Ending a perpetual trust

Though a perpetual trust can last forever, circumstances can change and it might not be needed any more. “The assets [could] no longer generate sufficient benefit or income for the intended beneficiaries and, in fact, the costs of administering the trust [could] outweigh the benefits,” says Grozinger.

So, the trust should spell out the terms of its own demise. It should have a clause stating when the trustee can wind it down, and whether the trustee may make that decision unilaterally.

Under Nova Scotia’s new rules, the courts also have the power to vary perpetual trusts, says Matthews. “Let’s say, 50 years from now, the beneficiaries agree the trust is a pain in the neck and they want to get rid of it. They could go to court and try to convince a judge that it’s not in their best interests that the trust continue,” he says.

The court could force the trust to wind up, even if one of the beneficiaries disagrees, he adds.

The trust should also outline how to distribute the remaining assets, says Poyser.

It could be according to a formula, the most common being a per stirpes distribution, where every branch of the family gets the same amount.

The client may want to donate any remaining money to charity when the last beneficiary dies. The trustee should have the authority and guidelines to pick a suitable recipient. Without that flexibility, the trust could be left without a final recipient.

“Who’s to say there’s going to be a United Way in 350 years?” says Poyser. However, the trust could specify the donations should go toward community development or to a poverty-oriented charity.

Despite the extra considerations for drafting a perpetual trust, Matthews is glad to see the old rule abolished, taking with it the potential for failed estates. Old perpetuities rules “didn’t achieve a lot, and caused a lot of harm.”

Where did the perpetuities rule come from?

The law against perpetual trusts came to Canada through English common law.

English aristocrats used to pass their country estates from generation to generation down the line, keeping property out of the market indefinitely. “The governments of that time thought it wasn’t good for the economy to have assets that couldn’t be fully utilized,” says Timothy Matthews, partner at law firm Stewart McKelvey in Halifax.

In 1682, the English designed a law limiting the number of generations that could have an interest in property.

In the 1800s, that law was reformed to limit interests to life-in-being plus 21 years, meaning the life of a designated beneficiary, plus 21 years.

In many places, that law is still on the books today. “Essentially the rule requires that all the conditions that tie up a property have to be satisfied before the perpetuity period expires,” says Matthews.

The law has harmed estate planning because the mere possibility that an interest could take longer than 21 years plus life-in-being voids the trust. As the gentry’s dominance faded in England, the need for the rule faded too. In 1964, England and Wales reformed their trust legislation to extend the perpetuities period to 125 years.

In Canada, since 1983, Manitoba, Saskatchewan and Nova Scotia have abolished the rule.

“The pitfalls created by the rule are too varied to be cured by any simple modification,” the Law Reform Commission of Saskatchewan said when it recommended abolishing that province’s rule in 1987.

Most other provinces have reformed the rule, either by extending the perpetuities period or allowing the trust time to vest, instead of voiding it automatically.

Matthews says more provinces will eventually abolish the rule outright. “This is one of the [rules] nobody loves.”

A trust is a vehicle for holding, and passing on, family property. As such, it typically serves at least one of two purposes: It can reduce a family’s taxes by shifting income to members in lower tax brackets, and it can provide for less fortunate (or more impulsive) members by controlling how their money is disbursed.

Because of the dividend tax credit and personal tax credit, for example, a Canadian without any other income – especially a student with deductible education expenses – could receive tens of thousands of dollars in dividends from Canadian companies tax-free. But while the family trust has a well-earned reputation as a tool for the wealthy, these benefits can reach deep into the middle class. For example, a special rule known as an estate freeze can make a trust indispensable for even modestly successful family businesses.

A trust is nothing more than a relationship. It occurs when one person, often called the settlor​, gives property to another person, the trustee, to manage on behalf of still other people (the beneficiaries). Using the estate freeze, for instance, owners of a growing company convert their shares of the existing business into preferred stock calibrated to the value of the business, and sell new common stock to the family trust that capture the company’s future growth.

By locking in the current generation’s stake at the company’s current value, they can prepare for the tax liability when they die without worrying about having to sell the company. Meanwhile, the next generation can share in the company’s profits through dividends allocated to the common shares.

A trust is not a legal entity that can enter into contracts or incur liability. Nor is the trust itself a contract that enforces obligations between any of the parties, though a beneficiary may sue a trustee for failing to act in the beneficiary’s best interest, which is known as a breach of fiduciary duty. As such, trusts are not particularly difficult to establish – in fact, technically speaking, most trusts don’t even require a founding document. But the tax law surrounding trusts is just as complex as one might expect – an individual interested in setting up a trust ought to talk to a lawyer first. Here is some of what you can expect to discuss.

Living or Estate Trust?

There are fundamentally two kinds of trusts. Testamentary trusts are created as part of a will and take effect upon the death of the testator. Recent changes to Canadian law took away the tax advantage of setting up long-term testamentary estate trusts,making them less useful.

Any other trust, including one using an estate freeze, is a living, or inter-vivos, trust, established while its architect is still alive. A living trust can be established for a variety of purposes – Canada Revenue Agency (CRA) has identified 31 different types of living trusts – for a variety of different beneficiaries.

Indeed, two new kinds of living trusts for senior citizens, so-called alter-ego and joint-spousal or common-law trusts, have begun replacing wills, according to tax lawyer Evelyn R. Schusheim of Toronto. Special rules allow an individual age 65 or older to roll over assets into these trusts without having to pay capital gains on the assets first. Only the individual (and the partner, in the case of a joint trust) can benefit from the trust while he or she is alive. When the settlor (or surviving partner) dies, the trust pays tax on realized capital gains, but the property in the trust can be distributed to heirs without being subject to probate fees.

Mind the Attribution Rules.

Though a Canadian trust is not a legal entity, it is under Canadian law a taxpayer – at the highest rates. That is why trustees try to pass on any income earned by trust property to beneficiaries – so they can pay the taxes at their own, presumably lower, rates. But in an effort to limit using trusts for tax avoidance, Canadian tax law attributes trust income to the person who transferred the property to the trust if the recipients are close relatives.

In general, these attribution rules apply when the beneficiary is either a spouse, or under the age of 18, in the case of dividend and interest income (but not capital gains). The attribution rules do not apply when the beneficiary is an adult child (or grandchild, or niece or nephew).

Other rules attribute the income to a transferor who can effectively control, or reclaim, the assets in the trust. There are exceptions, including alter-ego trusts and joint-partner trusts. But otherwise, the rules make revocable trusts, increasingly common in, for example, the U.S., difficult to use in Canada. (See also: How To Set Up A Trust Fund If You’re Not Rich.)

Choose a Settlor and Trustee.

The attribution rules guide these decisions. Since a transferor can’t control the property in a trust, she can’t be a sole trustee. (A transferor can be one of at least three trustees, provided she does not wield disproportionate influence.)

Usually, then, the person who is transferring the property that is to be put into trust asks someone else to be the settlor – a grandparent, perhaps, or close family friend. There are times, however, when you must appoint someone else, such as a trust company, as a trustee. For example, if you want to establish a trust in another province, the trustee (or a majority of trustees) must reside there. Other times to appoint an outside trustee are when you want pure independence or anticipate conflict within the family.

It’s important that the people who are designated trustees actually perform the work of trustee. In recent years Canada Revenue Agency has sought to clamp down on settlors or beneficiaries acting as de facto trustees.

Decide on What Property to Transfer.

A trust does not exist without some property being transferred, or as it’s called, settled – the prospect or promise of making the transfer is not enough to create a trust in advance. Moreover, given the attribution rules, it may be unwise to settle a trust with the actual property that will provide income or capital to the beneficiaries, though the settling property should have some value, otherwise, says Weigl, the trust’s legitimacy could be challenged. Weigl suggests using a silver or gold coin that is easily identified and kept in a safety deposit box. (If the trust is ever audited, revenue officials will want to know if the trustee still has it. “It becomes a bit of a record-keeping issue.”)

If a trust’s beneficiaries would otherwise trigger the attribution rules, the settlor or the individual with the real assets can avoid them by making what’s known as a prescribed interest rate loan, a documented loan with an interest rate no lower than the CRA prescribed interest rate.

The trust can then use the proceeds of the loan to purchase the assets it will hold. For example, in the case of an estate freeze, a small loan of, say, $100, ought be enough for the trust to buy the family company’s new common shares at a nominal par value. The trust can repay the loan when it receives the first dividend check.

The Bottom Line

A trust is not a contract or a legal entity, but given the complex attribution rules, it’s best to talk to a lawyer before setting one up. (See also: How To Set Up A Trust Fund In The U.K.)

I am astounded at how many Currency Recipients and Guru’s are still talking about setting up cabal Statutory Law Entities when we will be under the Restored Republic/Common Law, after GESARA’s Announcement. GESARA WILL have new Common Law Entities available at the right time but in the mean time I would like to share some Natural Common Law Trust information with you since I had been inundated with questions regarding these Financial Vehicles and how we can use them during and/or after Exchanging/Redeeming. What is the difference between Trusts and other Legal Entities based on Common Law, and ones based on Statutory Law?

Statutory law consists of millions of laws. They change every year and are so numerous and complicated that they require well paid lawyers to keep up with them. They have created a whole industry of lawyers that parasite off society because of it. Such laws are generally designed to benefit the few at the expense of the many — the lawyers, the politicians, the big corporations, and the cabal’s favored interests. Legal entities set up under statutory law are subject to those millions of laws, and require expensive and complicated legal expertise to defend them.

Common law, by contrast, has been around for millions of years, and will continue to be around for millions of years. It rarely changes. It’s basically, “Don’t lie, don’t steal, and don’t violate the rights of others.” It is the closest thing to natural law, or universal law, that is active in human affairs. It was the basis of the US court system until 1938. It is still the underlying authority, and is now returning in force. Witness the work of Kevin Annett and others, to expose the Pope using common law courts.

Trusts and legal instruments that are created under common law have far greater freedoms. They are subject only to the common law, and are thus sovereign and immune from the ever-changing statutory laws. They can go on generation after generation, well into the Golden Age, and flourish, because they’re based on what is timeless.

3) FFM – Featured Foundation of the Month!
It’s the PEACEFUL SPIRIT FOUNDATION!
Thomas has three major focus areas……all exciting and very much needed.
First, he will create a new nursing home model, similar to one in New York which was started by a medical doctor and is currently operating.  He will purchase one existing home with the potential for being upgraded to include many ways to serve:  adding pets such as dogs, cats and birds, improved nutrition and diets, gardens with flowers and nature areas, activities such as art and music, movement exercise, interesting educational seminars, energetic alternative health modalities, appropriate exercise programs, massage, etc., and retraining and adding caregivers as necessary, so as to involve the residents as much as possible in their own improved living circumstances and help them become more self-sufficient, active and positive about their lives.
His background as a special education teacher, a hospice volunteer and a lover of life prepares him well for this mission.  One daughter has extensive experience in hospital administration and will serve as the Director over all the nursing homes.  She will institute best practices, which in the nursing home industry are often not followed.  Another daughter is an interior decorator and will utilize her gifts to provide a lovely, uplifting atmosphere for all the residents.  Caregiver salaries will be increased appropriately.  As one location becomes successful he will add other locations, and create a chain across the country.  And this can serve as a model for others to copy.
Second, he will create a community modeled after one existing in Massachusetts, for seniors and families fostering children, and other interested residents, who will work together for the good of all residents and provide organic gardens, animals, involvement with nature and positive educational experiences.  Reportedly there is a similar facility being created in Redwood City, California.
Third focus area is quality day care for pre-schoolers, 0-3 years.  As a former special ed teacher he is well aware of this desperate need to serve young children better.

8) CPAs for Foundations
For existing foundations, the annual report Form 990PF is due May 15, with an extension available IF you file for it.  You can file your own; use Form 8868.  The extension is automatically granted, till November 15.
We have an ADDITIONAL CPA coming!  She’s moving to the Reno area in the next few months and she will soon be available to do your 990 PFs!  You may choose her or Robert Tese, our two current possibilities.  One benefit is that they are in Nevada so there is no nexus with any other state, no matter where trustees live.
And Karen, a trustee of a new Foundation, has found this proof (below) of what we have been saying all along, that a new Foundation can operate from day one as a tax-exempt organization.  Just follow the rules and do everything right.  Thank you, Karen!
“While Your Application is Pending, While an organization’s application is waiting for processing by the IRS, the organization may operate as a tax-exempt organization. Most organizations are required to file an annual information return (Form 990, Form 990-EZ or Form 990-PF) or electronic notice (Form 990-N) while their application for exemption is pending. An organization’s exempt status can be automatically revoked while its application is pending if it has not filed a required return or notice for three consecutive tax periods after its formation date. These returns are subject to public disclosure. If the organization has unrelated business income of more than $1,000, it must also file a Form 990-T. See Publication 4221-PC or 4221-PF for more information. Although donors have no assurance that contributions are tax-deductible for federal income tax purposes until the application is approved, contributions made while an application is pending would qualify if the application is approved. However, if the application is disallowed, contributions would not qualify. Moreover, the organization would be liable for filing federal income tax returns unless its income is otherwise excluded from federal taxation. TWO STORIES
A Story from China
A long time ago in China, a girl named Li-Li got married and went to live with her husband and mother-in-law.  In a very short time, Li-Li found that she couldn’t get along with her mother-in-law at all.
Their personalities were very different, and Li-Li was angered by many of her mother-in-law’s habits.  In addition, she criticized Li-Li constantly.  Days passed, and weeks passed.  Li-Li and her mother-in-law never stopped arguing and fighting.  But what made the situation even worse was that, according to ancient Chinese tradition, Li-Li had to bow to her mother-in law and obey her every wish.  All the anger and unhappiness in the house was causing Li-Li’s poor husband great distress.
Finally, Li-Li could not stand her mother-in-law’s bad temper and dictatorship any longer, and she decided to do something about it.
Li-Li went to see her father’s good friend, Mr. Huang, who sold herbs.  She told him the situation and asked if he would give her some poison so that she could solve the problem once and for all.
Mr. Huang thought for awhile, and finally said, “Li-Li, I will help you solve your problem, but you must listen to me and obey what I tell you.”
Li-Li said, “Yes, Mr. Huang, I will do whatever you tell me to do.”
Mr. Huang went into the back room, and returned in a few minutes with a package of herbs.  He told Li-Li, “You can’t use a quick-acting poison to get rid of your mother-in-law, because that would cause people to become suspicious.  Therefore, I have given you a number of herbs that will slowly build up poison in her body.  Every other day prepare some delicious meal and put a little of these herbs in her serving.  Now, in order to make sure that nobody suspects you when she dies, you must be very careful to act very friendly towards her.  Don’t argue with her, obey her every wish, and treat her like a queen.”
Li-Li was so happy.  She thanked Mr. Huang and hurried home to start her plot of murdering her mother-in-law.
Weeks went by, and months went by, and every other day, Li-Li served the specially treated food to her mother-in-law.  She remembered what Mr. Huang had said about avoiding suspicion, so she controlled her temper, obeyed her mother-in-law, and treated her like her own mother.
After six months had passed, the whole household had changed.
Li-Li had practiced controlling her temper so much that she found that she almost never got mad or upset.  She hadn’t had an argument with her mother-in-law in six months because she now seemed much kinder and easier to get along with.
The mother-in-law’s attitude toward Li-Li changed, and she began to love Li-Li like her own daughter. She kept telling friends and relatives that Li-Li was the best daughter-in-law one could ever find.  Li-Li and her mother-in-law were now treating each other like a real mother and daughter.
Li-Li’s husband was very happy to see what was happening.
One day, Li-Li came to see Mr. Huang and asked for his help again.  She said, “Dear Mr. Huang, please help me to keep the poison from killing my mother-in-law!  She’s changed into such a nice woman, and I love her like my own mother.  I do not want her to die because of the poison I gave her.”
Mr. Huang smiled and nodded his head.  “Li-Li, there’s nothing to worry about.  I never gave you any poison.   The herbs I gave you were herbs and vitamins to improve her health. The only poison was in your mind and your attitude toward her, but that has been all washed away by the love which you gave to her.”
There is a wise Chinese saying: “The person who loves others will also be loved in return.”  God might be trying to work in another person’s life through you.
Jazz and Sizzle – There is no time or space
Our cats, Jazz and Sizzle, are multidimensional beings and direct imports from the all-feline planet in our universe.  We learned some time ago that Jazz can bi-locate and does so when he chooses.  He can take himself outside to be in nature, when we have not let him out, and bring himself back in.
On Thursday morning Sizzle, our younger, bright-eyed, curious and still-learning cat, disappeared.  We searched everywhere for him, rattling the treat bag he loves!  We put out the word, went to vets in the area as Sizzle is chipped, and we asked Jazz to help, if he was willing to do so.  We did our best to be calm and send him love, but it was difficult!  We all felt sad, including Jazz.
Because of Merlin and St. Francis (who came to be the guest Being on our Thursday night call because of Sizzle being missing), we know the details.  This was Sizzle’s lesson, not to hurt us though we were missing him so much!  We were counseled to not be invested in his return, at this time.
He explored too far from home and 3 young adults driving by decided they wanted him.  They captured him and took him to their home, almost 2 miles away.  Sizzle would not cooperate, and they were determined to keep him but it was not going well.  And he has lethal claws!
Evening came, and around 9 pm I heard a meow.  I went outside and called Sizzle, but nothing.  I came back in, and about 5 minutes later I heard 2 meows.  I went outside again and looked thoroughly, but nothing.
Then Rod yelled, “He’s here!”  Rod was walking into our kitchen and there was no cat.  But a second later Sizzle was there in front of him.
What happened?  Jazz communicated with him and taught him how to come home.  They had never done this and Sizzle knew nothing about the process of bi-location.  It’s all energy.  Sizzle disappeared from the captors’ house (“Where’s the cat???”) and appeared on our kitchen floor.  Looking for food of course.  The meows I heard were his meows coming in, during the process.  And he was totally nonchalant about his ordeal and his learning to bi-locate.
The nonchalant attitude is because he thinks this is “normal”!  Well, only we humans have been given the idea that it’s not “normal”.

It’s the WELLNESS FOR HUMANITY FOUNDATION!
We know through much research and experience that the biological body is adaptable to energy frequencies, and that every area of the body has its own frequency.  When any of those frequencies change from normal, through injury or stress or the immune system not handling pathogens or bacteria, then one can feel symptoms, pain, inflammation or discomfort.

This purpose is so close to my heart, as my years teaching in the public school system burned into me the reality of how damaging that system is to kids, and how desperately it needs to be changed.  Peggy and Karen are DOING that!
The Foundation is about sponsoring gatherings and events open to the community for connecting children and families who want more, more creativity, more fun, more enrichment, more excitement regarding all kinds of learning experiences.  Crafts for kids, interactive meetings for the parents, information about what their for-profit does, and empowering a sense of relief for parents who know the public schools are disastrous for many kids and thus are seeking options, in order to help their kids thrive!  These public meetings will offer attendees opportunities to learn about the materials, books and other educational support alternatives available to families.
The Foundation is associated with West River Academy which is an accredited and affordable K-12 private school without walls, for all ages and grade levels.  They offer customized programs, self-paced learning, tailored to individual needs, abilities and goals, and ultimately graduation with an accredited high school diploma and an official transcript.  They are a California Private Satellite School (PSP) and an independent private school that complies with most states’ compulsory attendance rules.
Their programs are ideal for “unschoolers”, homeschooling parents, students in the entertainment industry, students who are gifted, disabled or have special needs, and families who travel from state to state or country to country.  Internationally, it is a legal way to opt out of public school.  Their website is WestRiverAcademy.com.

Most organizations are required to file an annual information return (Form 990, Form 990-EZ or Form 990-PF) or electronic notice (Form 990-N) while their application for exemption is pending. An organization’s exempt status can be automatically revoked while its application is pending if it has not filed a required return or notice for three consecutive tax periods after its formation date. These returns are subject to public disclosure. If the organization has unrelated business income of more than $1,000, it must also file a Form 990-T. See Publication 4221-PC or 4221-PF for more information. Although donors have no assurance that contributions are tax-deductible for federal income tax purposes until the application is approved, contributions made while an application is pending would qualify if the application is approved. However, if the application is disallowed, contributions would not qualify. Moreover, the organization would be liable for filing federal income tax returns unless its income is otherwise excluded from federal taxation. TWO TRUE STORIES
Jazz and the Dove

Jazz, our cat, is a magical being.  He is smart, savvy, comes when he is called and follows us around the house like a dog, talks and purrs a
blue streak, grooms himself incessantly and is the cleanest cat I've ever seen (anyone allergic to cats is not allergic to him), and made a
bed for himself under the Christmas tree but has not bothered any of the ornaments.  And every cat within 1/2 mile radius knows he is the boss!  Definitely an "alpha" male.

Rod is a gifted channeler, and was born seeing and hearing Spirit.  He has the innate ability in his hands to facilitate healings.  He is a true trance channel so the information and answers offered are clear and pure.

True story:  Rod and I hosted a Christmas party and during the evening he did a channeling as our gift to all who attended.  Lady Sophia,
Creator Goddess, came through and many wonderful questions were asked of her.  Part way through the evening one of our guests, Jadelynn, noticed that Jazz had brought in an injured bird, and she brought the dove to the group.  It was Jazz's way of participating in the session, the bird wanted help in transitioning, and Jazz played his part.  Jazz is a very accomplished hunter who brings us many "trophies".  However he did not injure the bird but found it already hurt and brought it in to us. 

Lady Sophia asked to hold the dove, and then we passed it around for each person to hold and bless and contribute to its healing.  Then I as
the last person put it outside on our lanai where it could rest and be safe.  The bird did transition but the energy we all gave it made the
passing on much easier for it.  It was a beautiful experience for all present.

And the help one provides is equally valuable whether the person or animal gets well or transitions.  Which way it goes is the soul's choice, always.


Christmas Eve 1881

Pa never had much compassion for the lazy or those who squandered their means and then never had enough for the necessities.  But for those who were genuinely in need, his heart was as big as all outdoors.  It was from him that I learned the greatest joy in life comes from giving, not from
receiving.  

It was Christmas Eve, 1881.  I was fifteen years old and feeling like the world had caved in on me because there just hadn't been enough money to buy
me the rifle that I'd wanted for Christmas.

We did the chores early that night for some reason.  I just figured Pa wanted a little extra time so we could read in the Bible.

After supper was over I took my boots off and stretched out in front of the fireplace and waited for Pa to get down the old Bible.  I was still feeling
sorry for myself and, to be honest, I wasn't in much of a mood to read Scriptures.  But Pa didn't get the Bible, instead he bundled up again and
went outside.  I couldn't figure it out because we had already done all the chores.  I didn't worry about it long though, I was too busy wallowing in
self-pity.  Soon Pa came back in.  It was a cold clear night out and there was ice in his beard.  "Come on, Matt," he said.  "Bundle up good, it's cold out
tonight."  I was really upset then.  Not only wasn't I getting the rifle for Christmas, now Pa was dragging me out in the cold, and for no earthly reason
that I could see.  We'd already done all the chores, and I couldn't think of anything else that needed doing, especially not on a night like this.  But I knew Pa was not very patient at one dragging one's feet when he'd told them to do something, so I got up and put my boots back on and got my cap, coat,and mittens.  Ma gave me a mysterious smile as I opened the door to leave the house.  Something was up, but I didn't know what.

Outside, I became even more dismayed.  There in front of the house was the work team, already hitched to the big sled.  Whatever it was we were going
to do wasn't going to be a short, quick, little job.  I could tell.  We never hitched up this sled unless we were going to haul a big load.  Pa was
already up on the seat, reins in hand.  I reluctantly climbed up beside him.  The cold was already biting at me.  I wasn't happy.

When I was on, Pa pulled the sled around the house and stopped in front of the woodshed.  He got off and I followed.  "I think we'll put on the high
sideboards," he said.  "Here, help me."  The high sideboards!  It had been a bigger job than I wanted to do with just the low sideboards on, but whatever
it was we were going to do would be a lot bigger with the high side boards on.
 
After we had exchanged the sideboards, Pa went into the woodshed and came out with an armload of wood - the wood I'd spent all summer hauling down from the mountain, and then all fall sawing into blocks and splitting.  What was he doing?  Finally I said something.  "Pa," I asked, "what are you
doing?"  "You been by the Widow Jensen's lately?" he asked.

The Widow Jensen lived about two miles down the road.  Her husband had died a year or so before and left her with three children, the oldest being eight.  Sure, I'd been by, but so what?

Yeah," I said, "Why?"  "I rode by just today," Pa said.  "Little Jakey was out digging around in the woodpile trying to find a few chips.  They're out of wood, Matt."  That was all he said and then he turned and went back into the woodshed for another armload of wood.  I followed him.  We loaded the sled so high that I began to wonder if the horses would be able to pull it.

Finally, Pa called a halt to our loading, then we went to the smoke house and Pa took down a big ham and a side of bacon.  He handed them to me and
told me to put them in the sled and wait.  When he returned he was carrying a sack of flour over his right shoulder and a smaller sack of something in
his left hand.  "What's in the little sack?" I asked.  Shoes, they're out of shoes.  Little Jakey just had gunny sacks wrapped around his feet when he
was out in the woodpile this morning.  I got the children a little candy too.  It just wouldn't be Christmas without a little candy."

We rode the two miles to Widow Jensen's pretty much in silence.  I tried to think through what Pa was doing.  We didn't have much by worldly standards.  Of course, we did have a big woodpile, though most of what was left now was still in the form of logs that I would have to saw into blocks and split before we could use it.  We also had meat and flour, so we could spare that, but I knew we didn't have any money, so why was Pa buying them shoes and candy?  Really, why was he doing any of this?  Widow Jensen had closer neighbors than us; it shouldn't have been our concern.

We came in from the blind side of the Jensen house and unloaded the wood as quietly as possible, then we took the meat and flour and shoes to the door.  We knocked.  The door opened a crack and a timid voice said, "Who is it?"  "Lucas Miles, Ma'am, and my son, Matt... could we come in for a bit?"

Widow Jensen opened the door and let us in.  She had a blanket wrapped around her shoulders.  The children were wrapped in another and were sitting in front of the fireplace by a very small fire that hardly gave off any heat at all.  Widow Jensen fumbled with a match and finally lit the lamp.

"We brought you a few things, Ma'am," Pa said and set down the sack of flour.  I put the meat on the table.  Then Pa handed her the sack that had
the shoes in it.  She opened it hesitantly and took the shoes out, one pair at a time.  There was a pair for her and one for each of the children -
sturdy shoes, the best... shoes that would last.

I watched her carefully.  She bit her lower lip to keep it from trembling and then tears filled her eyes and started running down her cheeks.  She looked up at Pa like she wanted to say something, but it wouldn't come out.

"We brought a load of wood too, Ma'am," Pa said.  He turned to me and said, "Matt, go bring in enough to last awhile.  Let's get that fire up to size
and heat this place up."

I wasn't the same person when I went back out to bring in the wood.  I had a big lump in my throat and as much as I hate to admit it, there were tears
in my eyes too.  In my mind I kept seeing those three kids huddled around the fireplace and their mother standing there with tears running down her
cheeks with so much gratitude in her heart that she couldn't speak.

My heart swelled within me and a joy that I'd never known before, filled my soul.  I had given at Christmas many times before, but never when it had
made so much difference.  I could see we were literally saving the lives of these people.

I soon had the fire blazing and everyone's spirits soared.  The kids started giggling when Pa handed them each a piece of candy and Widow Jensen
looked on with a smile that probably hadn't crossed her face for a long time.  She finally turned to us.  "God bless you," she said.  "I know the Lord has sent you.  The children and I have been praying that he would send one of his angels to spare us."

In spite of myself, the lump returned to my throat and the tears welled up in my eyes again.  I'd never thought of Pa in those exact terms before, but
after Widow Jensen mentioned it, I could see that it was probably true.  I was sure that a better man than Pa had never walked the earth.  I started
remembering all the times he had gone out of his way for Ma and me, and many others.  The list seemed endless as I thought on it.

Pa insisted that everyone try on the shoes before we left.  I was amazed when they all fit, and I wondered how he had known what sizes to get.  Then
I guessed that if he was on an errand for the Lord, that the Lord would make sure he got the right sizes.

Tears were running down Widow Jensen's face again when we stood up to leave.  Pa took each of the kids in his big arms and gave them a hug.  They
clung to him and didn't want us to go.  I could see that they missed their Pa, and I was glad that I still had mine.
 
At the door Pa turned to Widow Jensen and said, "The Mrs. wanted me to invite you and the children over for Christmas dinner tomorrow.  The turkey
will be more than the three of us can eat, and a man can get cantankerous if he has to eat turkey for too many meals.  We'll be by to get you about
eleven.  It'll be nice to have some little ones around again.  Matt, here, hasn't been little for quite a spell."  I was the youngest... my two brothers and two sisters had all married and had moved away.  Widow Jensen nodded and said, "Thank you, Brother Miles.  I don't have to say, may the Lord bless you, I know for certain that He will."

Out on the sled I felt a warmth that came from deep within and I didn't even notice the cold.  When we had gone a ways, Pa turned to me and said,
"Matt, I want you to know something.  Your Ma and me have been tucking a little money away here and there all year so we could buy that rifle for
you, but we didn't have quite enough.  Then yesterday a man who owed me a little money from years back came by to make things square.  Your Ma and me were real excited, thinking that now we could get you that rifle, and I started into town this morning to do just that, but on the way I saw little
Jakey out scratching in the woodpile with his feet wrapped in those gunny sacks and I knew what I had to do.  Son, I spent the money for shoes and a
little candy for those children. I hope you understand."

I understood alright... and my eyes became wet with tears again.  I understood very well, and I was so glad Pa had done it.  Now the rifle seemed very low on my list of priorities.  Pa had given me a lot more.  He had given me the look on Widow Jensen's face and the radiant smiles of her three children.

For the rest of my life, whenever I saw any of the Jensens, or split a block of wood, I remembered, and remembering brought back that same joy I
felt riding home beside Pa that night.  Pa had given me much more than a rifle that night, he had given me the best Christmas of my life!

3) FFM – Featured Foundation of the Month!
It’s the ALLOW LOVE FOUNDATION!  How could I not feature this one here?  :-)))  Rod is my new husband, and his purposes are so magnificent and I am so proud of him!  It is an Operating Foundation which will focus in several areas, teaching, workshops, seminars, trainings, conferences, men’s groups, women’s celebrations and more.
The Allow Love Foundation is training Metaphysical practitioners in many different disciplines.  This training is so these practitioners can go into the world and help people with their particular brand of Metaphysics.  Depending on that brand the training will take as long as two years.  Current website is www.AllowLove.com.
If the focus is on healing, there are many different healing modalities available to the practitioner.  Intuitive Reiki is a powerful healing modality but certainly not the only one.  The Foundation offers three degrees of Intuitive Reiki.  First degree can be taught easily and quickly.  Second degree allows the practitioner to offer healing to the public.  Master Teacher allows the practitioner to teach Intuitive Reiki.  Other healing modalities will be taught as well.
Channeling will be taught also.  There are three ways of receiving that one can utilize for benefitting others:  Clairvoyance—seeing the information, Clairaudience—hearing the information, and last but not least, Clairsentience—feeling the information, which is the biggest challenge but can give the most detail.  All are taught at the Allow Love Foundation.
The Allow Love Center will be about teaching practitioners and supporting them, as well as workshops etc.  The number and types of modalities will most likely depend on the teachers at the Center.  We believe in using the talents and skills of those present without dogmatic adherence to how things were done in the past.  There will be teachers of channeling, healing, animal communication, how to allow a horse to love you, and many more.  And we will run conferences on metaphysical topics as well as have guest speakers on many and diverse subjects.
The Center will be on over 600 acres of land, and about 11,000 sq. ft., with a large conference room, many rooms for classes, a gourmet kitchen, a fountain and stream that will run around the entire building, horses, wolves, cats and many other animals as well.
We honor and prize imagination, creativity, higher awareness and consciousness, and we encourage individuals developing to their own greatest potential.

This is most exciting and I am so looking forward to assisting in bringing this Center into beingness.  Congratulations, Rod!

For existing foundations, Form 990PF is due May 15, with extensions available IF you file for them.  You can file your own, and it is Form 8868.  This is someone I trust, and he is partner in a reputable firm in Pasadena.  Name: Jamen Wurm, Goehner Accountancy, 251 South Lake Avenue Suite 190, Pasadena, California 91101.  626-449-6321.  He understands non-profits and foundations and I am sure can serve your Foundation’s needs well.

TWO STORIES
WET PANTS
Come with me to a third grade classroom.  There is a nine-year-old kid sitting at his desk and all of a sudden, there is a puddle between his feet and the front of his pants is wet.  He thinks his heart is going to stop because he cannot possibly imagine how this has happened.  It’s never happened before, and he knows that when the boys find out he will never hear the end of it.  When the girls find out, they’ll never speak to him again as long as he lives.
The boy believes his heart is going to stop.  He puts his head down and prays this prayer, ‘Dear God, this is an emergency!  I need help now!  Five minutes from now I’m dead meat.’
He looks up from his prayer and here comes the teacher with a look in her eyes that say he has been discovered.
As the teacher is walking toward him, a class mate named Susie is carrying a goldfish bowl that is filled with water.  Susie trips in front of the teacher and inexplicably dumps the bowl of water in the boy’s lap.
The boy pretends to be angry, but all the while is saying to himself, ‘Thank you, Lord! Thank you, Lord!’
Now all of a sudden, instead of being the object of ridicule, the boy is the object of sympathy.  The teacher rushes him downstairs and gives him gym shorts to put on while his pants dry out.  All the other children are on their hands and knees cleaning up around his desk.  The sympathy is wonderful.
But as life would have it, the ridicule that should have been his has been transferred to someone else – Susie.
She tries to help, but they tell her to get out.  ‘You’ve done enough, you klutz!’
Finally, at the end of the day, as they are waiting for the bus, the boy walks over to Susie and whispers, ‘You did that on purpose, didn’t you?’  Susie whispers back, ‘I wet my pants once too.’
Let’s get inspired and aware so that we see the opportunities that are always around us to do good.
THE  BRICK

A young and successful executive was traveling down a neighborhood street, going a bit too fast in his new Jaguar.  He was watching for kids darting out from between parked cars and slowed down when he thought he saw something.  As his car passed, no child appeared.  Instead, a brick smashed into the Jag’s side door!  He slammed on the brakes and backed the Jag back to the spot where the brick had been thrown.The angry driver then jumped out of the car, grabbed the nearest kid and pushed him up against a parked car shouting, ‘What was that all about and who are you?  Just what the heck are you doing?  That’s a new car and that brick you threw is going to cost a lot of money.  Why did you do it?’

The young boy was apologetic.  ‘Please, mister…please, I’m sorry but I didn’t know what else to do,’ he pleaded.  ‘I threw the brick because no one else would stop.’  With tears dripping down his face and off his chin, the youth pointed to a spot just around a parked car.  ‘It’s my brother’, he said.  ‘He rolled off the curb and fell out of his wheelchair and I can’t lift him up.’
Now sobbing, the boy asked the stunned executive, ‘Would you please help me get him back into his wheelchair?  He’s hurt and he’s too heavy for me.’
Moved beyond words, the driver tried to swallow the rapidly swelling lump in his throat.  He hurriedly lifted the handicapped boy back into the wheelchair, then took out a linen handkerchief and dabbed at the fresh scrapes and cuts.  A quick look told him everything was going to be okay.  ‘Thank you and may God bless you,’ the grateful child told the stranger.
Too shook up for words, the man simply watched the boy push his wheelchair-bound brother down the sidewalk toward their home.  It was a long, slow walk back to the Jaguar.  The damage was very noticeable, but the driver never bothered to repair the dented side door.  He kept the dent there to remind him of this message:  ‘Don’t go through life so fast that someone has to throw a brick at you to get your attention!’
God/Goddess whispers in our souls and speaks to our hearts.  Sometimes when we don’t have time to listen, S/He has to throw a brick at us.  It’s our choice to listen or not!
